The following excerpt is from Vukorep v. Bartulin, 2004 BCSC 585 (CanLII):

I am satisfied that it is the responsibility of the owner to ensure that the vessel is seaworthy in the sense of being fit with proper equipment for the intended voyage. See Conrad v. Snair at para. 115: the owner must ensure the vessel is "...seaworthy in the sense of being fit for the intended voyage, in good repair and properly equipped, and safe for those on board".
