In Law Society of Upper Canada v. Painter, [1998] L.S.D.D. No. 99, the lawyer acted in a conflict of interest where he was an investor and legal counsel but where the complainant actually made a substantial profit. The lawyer was under extreme stress, including marital difficulties, and he was granted permission to resign.
