To begin, I think it important to appreciate that the field of radio frequency engineering is a recognized expertise grounded in sound scientific principles. The foundation for the proposed opinion evidence rests in the law of physics, on the behaviour of electromagnetic waves when propagated (transmitted) from one point to another. For the forensic purposes advanced here, electromagnetic wave propagation finds expression in a general rule that explains the relationship between a cellular tower and a cell phone, succinctly explained in R v. Hamilton, supra: … a call to or from a cell phone will usually register at the tower closest to that cell phone. The basis of the general rule is that a cell phone will register at the tower with the strongest signal, which is usually, though not always, the closest tower.
