Although the individual Plaintiffs could be charged with an offence under the act, this has not occurred. Private interest standing “cannot be founded on hypothetical possibilities:” Downtown Eastside Sex Workers United Against Violence Society v. Canada (Attorney General), 2008 BCSC 1726 at para 47. I find that the individual Plaintiffs do not have private interest standing.
