I agree with the comments expressed in M’Carton v. Belfast Harbour Commr., [1911] 2 I.R. 143 at 145: … it is an endless and unprofitable task to compare the details of one case with the details of another, in order to establish that the conclusion from the evidence in the one must be adopted in the other also. Given the rule of law, the facts of each case must be independently considered, in order to see whether they bring it within the rule or not.
