During this trial I heard from a number of witnesses. Not surprisingly, there are significant and minor discrepancies in the testimony of those witnesses. I begin my assessment of the evidence of the witnesses with a presumption of truthfulness. Testimony under oath or affirmation is presumed to be true unless that presumption is displaced: Halteren v. Wilhelm [2000] B.C.J. No. 17 (B.C.C.A.).
