The following excerpt is from Young v. Dawe, 1998 CanLII 18089 (NL CA):

Because of the reversal of the trial judgment on the issue of prejudgement interest, it can be said that success on this appeal was divided. However, it must be recognized that the dismissal of the other appeal issues means that, in reality, the respondent was the major winner. Unlike the situation in Taylor v. Hogan where the appellant was successful, not only on the issue of prejudgment interest, but also on some of the issues respecting calculation of certain heads of the damage claim, this is not a case where it would be appropriate to order that each party bear his or her own costs of the appeal.
