In Munro v. James, 2020 BCSC 1348, the testator sought to terminate an agreement (made in writing). The court found that the testamentary contract was enforceable. In that case the testator had agreed to leave her estate to a couple in exchange for that couple providing services to the testator for the remainder of her life. The testator was not entitled to terminate the agreement.
