The appellant submits that the time commenced to run on the day that the reasons for judgment were published by filing in the registry in which the matter had been commenced, namely 10th January 1984. Counsel for the appellant relies upon Bank of Montreal v. Koszil, [1983] B.C.W.L.D. 011, B.C.C.A., Vancouver No. CA821323, 19th November 1982 (not yet reported) (a judgment of Anderson J. A. in chambers). In the latter case the reasons of the trial judge were signed on 8th October 1982 but were filed in the court registry on 12th November 1982, as evidenced by the registry date stamp. Anderson J.A. held that 12th November 1982 was the date of the pronouncement of the judgment. He said: Pronouncement is when the reasons are published and it is presumed that they are published on the date that they are received in the registry and the date stamp placed on the reasons for judgment. I agree with that conclusion and I am bound by it, unless there is higher authority to the contrary.
