Now, in these applications, the burden of proof is on the City. In a case called Regina v. Demster in the British Columbia Court of Appeal, it says that a civil balance of probabilities test is the appropriate test. As I will mention later, even if it was a criminal beyond a reasonable doubt test as applied to this proceeding, it would be made out.
