Among the cases cited by counsel, and many others which I have considered, that of Walker v. Nussey, 16 M. & W. 302, 16 L.J. Ex. 120, appears to me to have the closest bearing. That is a decision of long standing, and is cited in all modern works on the subject as good law. There the plaintiff owed the defendant a sum of £4 odd. The parties then verbally agreed that the plaintiff should sell to the defendant goods above £10 in value according to a given sample, the plaintiff’s debt to go in part payment, and the residue to be paid by the defendant. Subsequently, the plaintiff sent the goods to the defendant, but the defendant refused to accept same.
