Despite receiving legal advice more than a month and half before the expiration of the limitation period, the applicant did not file his Application in time. An applicant must not delay in making a claim under the Code in order to gather evidence that confirms their suspicions or supports their case. See Klein v. Toronto Zionist Council, 2009 HRTO 241.
