The following excerpt is from Ioannou v. Evans, 2008 CanLII 117 (ON SC):

If Kostecki v. Goodman, supra, is authority that the collection of circumstances in the case at bar constitutes the rare special circumstances sufficient to justify an amendment after the expiry of a limitation period, then I think it was wrongly decided, and I will not follow it.
