The Act does not prescribe the process for the Commissioner to follow before deciding whether to exercise what has been described as the “wide” discretion not to commence an investigation (Detorakis v. Canada (Attorney General), 2010 FC 39, 358 F.T.R. 266 at para. 43). In particular, the Act does not specify that the Commissioner will communicate to persons who have made disclosures the basis on which the Commissioner is considering exercising this discretion. However, it includes among the Commissioner’s duties (in paragraph 22(d)) the duty to “ensure that the right to procedural fairness and natural justice of all persons involved in investigations is respected, including persons making disclosures […]”.
