Szilard was a case involving an arbitrator. Rand J.’s statement was reaffirmed in Ghirardosi v. British Columbia (Minister of Highways), 1966 CanLII 47 (SCC), [1966] S.C.R. 367 at p. 370 and endorsed in Blanchette as being equally applicable to judges.
