In Solosky v. The Queen, 1979 CanLII 9 (SCC), [1980] 1 SCR 821 at 837, 105 D.L.R. (3d) 745, Dickson J., as he then was, determined that the following criteria are necessary to establish the existence of a solicitor-client privilege: “(i) a communication between solicitor and client, (ii) which entails seeking or giving of legal advice; and (iii) which is intended to be confidential”.
