The following excerpt is from R. v. Porter, 2001 BCPC 191 (CanLII):

There is no possibility of giving consideration to simple probation here - a jail sentence is certainly necessary. In Regina v. Dukeshire sentences after trial of four and five years were imposed, the latter involving an accused with a relatively serious record. The present case has three main differences - there were guilty pleas, no weapon per se was taken to the crime scene, and neither accused was directly involved in the violence upon the victim. This leads me to conclude that the range of sentence in this case should be three to four years in the penitentiary. It should be somewhat less than the general indication of four years in Dukeshire.
