Applying the test set out in Regina v. D. W., supra, to the balance of the evidence, I find there are cogent reasons for disbelieving the accused's version of the events. First, the accused has a motive to minimize his culpability for the complainant's injury because of the adverse impact a finding of criminal responsibility may have on his application for joint custody of their son.
