The conservation officer already knew that the occupants of the truck had apparently been conducting themselves unlawfully; or, at least, that some of them had. What occurred here was more than a minor limit placed on the charter rights of the accused. It went to the heart of the matter. As Mr. Justice Parrett said in Regina v. Taylor and Atkinson, [2001} B.C.J. No. 2112, B.C.P.C. at paragraph 31: When looking at the statements given to conservation officers by hunters, it is also important to examine the type of information provided as well as under what circumstances and for what purpose the information is being elicited.
