Page 31, Question 160 to page 32, Question 163: To answer questions relating as to whether he was going through a stressful period for any particular reason in June of 1998. Although there is no claim being made here, of the accident having affected his sexual dysfunction, there is a claim for mood lability, anxiety, and ever since then, depression. Using the reasoning of Mr. Justice White in Wark v. State Farm, since he is making a claim for an impact on his capacity to work, his whole medical history is a proper subject of the defendant’s inquiry for Discovery purposes and therefore I am ordering that he answer the question whether he was going through a stressful period for any particular reason in June of 1998.
