Alternatively, the claim of the plaintiff is advanced for unjust enrichment. In Pettkus v. Becker, 1980 CanLII 22 (SCC), [1980] 2 S.C.R. 834, three circumstances were referred to by Dickson, J. as giving rise to a remedy for unjust enrichment, namely: 1. Enrichment to the defendant; 2. A corresponding deprivation of the plaintiff; and 3. The absence of any juristic reason for the enrichment.
