The following excerpt is from Pushka v. Magnowski Estate, 1983 CanLII 3684 (MB QB):

Nor is there any substance to the suggestion that the solicitor for the executrix exceeded her authority; the executrix understood and approved what the solicitor did, but later improperly repudiated the arrangement and insisted on receiving offers for all the property in both estates. The decision in Paw v. McPhee (1917), 50 N.S.R. 448, is of no assistance to the defendant. In that case a solicitor, acting for both plain tiff and defendant, purported to make a sale to the plaintiff without ever sub mitting the offer for the defendant's acceptance.
