38 Finally, defendants' counsel drew my attention to the case of Zorzi and Zorzi v. Barker and Barker (1957), 44 B.C.L.R. (2d) 164 from our Court of Appeal. With respect, I can find no evidence that this was a case involving a no evidence motion. Consequently, it is not applicable to my determination here.
