The Hearing Panel sees no reason to deviate from the general rule that costs follow the cause. Mortgage fraud cases are by their very nature costly to investigate and costly to prosecute. Unfortunately they are also becoming more prevalent. It is a general principle that the profession should not bear the burden of these costs (Law Society of Upper Canada v. Baker, [2006] L.S.D.D. No. 31).
