In Marley v. Kains, 2011 BCSC 1306, as in this case the plaintiff was a candidate in a provincial election attending an all-candidates forum. While no defamatory expression was found and qualified privilege applied the case is of assistance as it makes clear why qualified privilege existed in that case and assists in assessing why qualified privilege does not apply here.
