In Hub International (Richmond Auto Mall) Ltd v. Mendham, 2012 BCSC 182 the plaintiff was an insurance agency and the defendant had been head of its marine insurance division. Greyell J. granted an injunction enforcing a one year prohibition against soliciting a “customer, client or supplier of the company.” Although the contract and the injunction referred to all customers or clients, not only those with whom the defendant had dealt, I note that the marine insurance business in which the defendant specialized was an identifiable “niche market” within both the industry and the plaintiff’s operations.
