The following excerpt is from Ager v. Canjex Publishing Ltd., 2003 BCSC 891 (CanLII):

And further at para. 48: ...That is a problem which is likely to arise frequently where the media elects to take advantage of the new weapon put in its hands by [Hill v. Church of Scientology of Toronto]. It is a weapon which has great capacity for causing harm to innocent people. On the law as it stands, that potential damage can be kept within reasonable limits only by requiring of the media a greater effort to achieve balance than is expected in ordinary reporting of court proceedings where the evidence that is reported on is that which the judge allows to be heard after both parties have had an opportunity, usually through counsel, to raise issues of relevancy.
