The court must consider the plaintiff’s pre-accident capacity to earn income contrasted with his capacity after the accident. The standard of proof for both types of lost income claims is based on a real and substantial possibility of such losses and not on mere speculation: see Athey v. Leonati, 1996 CanLII 183 (SCC), [1996] 3 S.C.R. 458.
