The following excerpt is from Popack v Lipszyc, 2015 ONSC 3460 (CanLII):

Albeit in a different context, Kane v. Board of Governors of U.B.C., 1980 CanLII 10 (SCC), [1980] 1 S.C.R. 1105, at p. 1113 (per Dickson J., as he then was, for the majority), makes it clear that private interviews with witnesses are improper except where the decision-maker is expressly or by necessary implication empowered to act ex parte.
