Judicial impartiality is a well-settled and foundational principle in which public confidence in our legal system is rooted: Wewaykum Indian Band v. Canada, 2003 SCC 45, [2003] 2 SCC 45, [2003] 2 S.C.R., at para. 57. There is a strong presumption of judicial impartiality and a heavy burden on a party who seeks to rebut this presumption: Langstaff v. Marson, 2014 ONCA 510, 121 O.R. (3d) 369, at para. 24.
