The following excerpt is from People v. Cooks, 141 Cal.App.3d 224, 190 Cal.Rptr. 211 (Cal. App. 1983):
[141 Cal.App.3d 289] On appeal from a judgment of conviction, the defendant (appellant), in order to demonstrate a violation of his Sixth Amendment rights due to a conflict of interest in joint representation, must establish that an actual conflict of interest adversely affected his lawyer's performance. The mere "possibility of conflict is insufficient to impugn a criminal conviction." (Cuyler v. Sullivan, supra, 446 U.S. 335, 350, 100 S.Ct. 1708, 1719, 64 L.Ed.2d 333.)
