Is there a presumption of prejudice against a jury in a case where the jury was unable to reach a verdict?

California, United States of America

The following excerpt is from People v. Cooper, 281 Cal.Rptr. 90, 53 Cal.3d 771, 809 P.2d 865 (Cal. 1991):

12 This case does not involve improper outside influences on the jury through no fault of its own. We therefore do not decide whether there is a presumption of prejudice in that situation. (Cf. Remmer v. United States (1954) 347 U.S. 227, 74 S.Ct. 450, 98 L.Ed. 654.)
