The following excerpt is from R. v. MacPhail, 2011 ONCJ 184 (CanLII):

[120] Having found a stay of the proceedings is not appropriate, the next consideration is whether the exclusion of the various statements from the evidence is appropriate. I find that such relief would be equally inappropriate as well and completely disproportionate to the circumstances of the breach, given a proper analysis as set out in Regina v. Grant.
