The following excerpt is from People v. Byrd, 1 Cal.App.5th 1219, 205 Cal.Rptr.3d 670 (Cal. App. 2016):

A defendant in a criminal case, of course, is entitled to the benefit of every reasonable doubt, but the record shows that by the conduct of defendant and all other participants at the trial, no doubt was raised that defendant was conceding the cause of death. (People v. Peters , supra, 96 Cal.App.2d at pages 675678, 216 P.2d 145 ; emphasis added.)
