In Irvine v. Smith, the defendant’s adult son, who was exhibiting signs of psychosis, ran out into the street and was hit by the plaintiff’s car. The plaintiff brought a claim against the father, alleging that the father had a duty to take his son to the hospital once he was exhibiting signs of psychosis. Rady J. rejected this allegation, finding that the father had no legal relationship of supervision or control over his adult son such that he would owe the plaintiff a duty of care.
