In what circumstances will the court reverse a conviction for assault on a defendant based solely on the testimony of a non-English-speaking witness?

California, United States of America

The following excerpt is from Stevenson v. Superior Court, 154 Cal.Rptr. 476, 91 Cal.App.3d 925 (Cal. App. 1979):

Similarly, in People v. Johnson (1975) 46 Cal.App.3d 701, 120 Cal.Rptr. 372, the court reversed a conviction based almost exclusively on the [91 Cal.App.3d 930] preliminary hearing testimony of a Spanish-speaking witness, admitted at trial on the basis that the witness was unavailable, over a defense showing that there were significant errors in the interpreter's translation of the testimony. The court concluded that no "meaningful opportunity to cross-examine" had existed. (46 Cal.App.3d at p. 704, 120 Cal.Rptr. 372.)
