Recently, in Furtado v. Maasanen, 2020 BCSC 1340 Madam Justice Murray held that “if evidence of extenuating circumstances is presented, the adjudicator must consider it to determine whether those circumstances prevented the landlord from accomplishing … the stated purpose for ending the tenancy”, (para. 32).
