Can a notice of motion be returned after the two-month limitation?

Alberta, Canada

The following excerpt is from Fraser v. Calgary (City), 1977 CanLII 629 (AB QB):

I would agree with the decision of Tavender D.C.J. in Singer v. Calgary, supra. In the present application the notice of motion was made returnable after the two-month limitation. The court therefore lacks jurisdiction to hear the application.
