How have courts interpreted findings of fact and conclusions of law in a medical malpractice case?

California, United States of America

The following excerpt is from Estate of Spirtos, 109 Cal.Rptr. 919, 34 Cal.App.3d 479 (Cal. App. 1973):

5 Since findings of fact and conclusions of law were waived by the parties, we do not have an express statement of the trial court's determination as to appellant's negligence. However, in the absence of findings, we must imply in support of the judgment that all reasonable and necessary findings were made. (Block v. Laboratory Procedures, 8 Cal.App.3d 1042, 87 Cal.Rptr. 778; Wise v. Clapper, 257 Cal.App.2d 770, 65 Cal.Rptr. 231.)
