In Han v. Park, 2013 BCSC 2296, Fitzpatrick J. addressed an application for double costs brought against a plaintiff who was on a disability payment. Fitzpatrick J. considered that the plaintiff’s “actions and inaction in the litigation [showed] more than sufficient reason to justify the ‘penalty’”; at para. 63.
