The proper procedure to determine whether an unequal division of family assets is appropriate is for the judge to decide whether an equal division would be unfair before considering a re-apportionment. See Holmes v. Matkovich, 2008 YKCA 10 at paras. 13-15. Under the FPS Act, the triggering date is the date of separation (s. 6).
