An example of a duty of care arising at an operational level arose in City of Kamloops v. Nielsen, supra. In that case, the City had made the policy decision to enforce the bylaw and had established an inspection system to do so. The actual inspection of houses was within the operational sphere and could be subject to a duty of care.
