3. The latest version of CALCRIM No. 400 includes brackets around the word "equally." The current Bench Notes advise: "Before instructing the jury with the bracketed word 'equally, ' the court should ascertain whether doing so would be in accord with the... principles articulated in People v. McCoy (2001) 25 Cal.4th 1111, 1115-1116... and People v. Samaniego (2009) 172 Cal.App.4th 1148, 1166...."
