Because we have concluded that capital defendants and noncapital defendants are not similarly situated, the death penalty law does not violate equal protection by denying capital defendants various procedural rights given to noncapital defendants. (People v. Riggs, supra, 44 Cal.4th at p. 330, 79 Cal.Rptr.3d 648, 187 P.3d 363.)
