California, United States of America
The following excerpt is from Sanders v. PNC Bank N.A., G053551 (Cal. App. 2018):
2. "The California Homeowner Bill of Rights prohibits, among other things, 'dual track' foreclosures, which occur when a servicer continues foreclosure proceedings while reviewing a homeowner's application for a loan modification; requires a single point of contact for homeowners who are negotiating a loan modification; and expands notice required to be given to the borrower before the lender can take action on a loan modification or pursue foreclosure." (Lueras v. BAC Home Loans Servicing, LP (2013) 221 Cal.App.4th 49, 86, fn. 14.)
3. Sanders also "updated" an unsupported factual claim made in the first brief. The updated claim was likewise unsupported.
