Because section 422 is not ambiguous, and defendant's competing construction is unreasonable in that it renders a portion of the statute nugatory, the rule of lenity (People v. Hill, supra, 37 Cal.App.4th at p. 226) does not apply and defendant is not entitled to the construction of the statute most favorable to him.
