In Goodman v. Rossi, Morden A.C.J.O. expressly limited his ruling on the use of documents obtained on discovery stating at p. 365: I say at the outset that, because this is a case concerned with a document obtained on discovery, and not information obtained on examination for discovery, I shall confine this discussion to documents obtained on discovery. It may be that information obtained on examination for discovery does not raise exactly the same issues. I shall discuss it briefly later.
