In Docouto v. Ontario (Attorney General), [2000] O.J. No. 3322, Nordheimer J. was dealing with an issue where the facts are similar to those in this case. In that case, counsel for the defendants submitted a “place holder” Response to an RTA two days late. He then requested that counsel for the plaintiff consent to the late filing of a proper Response which they declined to do, so a motion was brought.
