Dixon v. British Columbia Transit (1995), 9 B.C.L.R. (3d) 108 (B.C.S.C.) was a case where aggravated and punitive damages were awarded when an employee had been discharged for cause when there was no cause. The employer told the media that the employee had been dismissed for cause. The employee successfully sued for damages for wrongful dismissal and for negligent misrepresentation. The trial held that the employer had committed the tort of deceit. It is to be observed that although aggravated damages were awarded the impugned conduct constituted an independent and actionable wrong.
