They rely on Jennings v. Latendresse, 2013 ONSC 1017 (at paras. 7-8), and argue that their conduct was consistent with what would be expected in an application of this nature. Just because it was not proven and they ultimately lost does not mean that their positions were so egregious as to warrant a punitive costs award on a substantial indemnity scale.
